General Terms and Conditions
of BAER Tools GmbH represented by its managing directors Eric Ollinger and Paul Kuhn, Robert-Bosch-Str. 5, 68542 Heddesheim for the website https://baer.tools (hereinafter: BAER)
§ 1 Scope of application
These GTC apply to all claims arising from contracts concluded between BAER and the Buyer (hereinafter referred to as the Buyer) via the website https://baer.tools in the version valid at the time of the order. The Seller primarily offers tools via its website, in particular screw tap and inserts. The following terms and conditions as well as the text of the contract are written in German and can be loaded into the Buyer's memory and printed out. If desired, they can be requested in digital or written form at the e-mail address info@baercoil.com.
§ 2 Conclusion of contract
(1) The Buyer can select products from BAER's range, especially tools, in particular screw tap and inserts, and collect them in a so-called shopping basket by clicking the button "Add to basket". By clicking on the button "Order subject to payment", the buyer submits a binding application to purchase the goods in the shopping cart. Before submitting the order, the buyer can change and view the data at any time; the buyer has the opportunity to correct input errors before confirming his offer (e.g. by clicking the back button or cancelling the order process and changing the previous input or by clicking the edit button). However, the application can only be submitted and transmitted if the Buyer, by clicking on the button I accept your general terms and conditions of business and delivery, has accepted these contractual terms and conditions and thereby incorporated them into his application.
(2) BAER will then send the Buyer an automatic acknowledgement of receipt by e-mail, in which the Buyer's order is listed again and which the Buyer can print out using the Print function. The automatic acknowledgement of receipt merely documents that the Buyer's order has been received by BAER and does not constitute acceptance of the application. The contract shall only come into existence upon the submission of the declaration of acceptance by BAER, which shall be sent with a separate e-mail (order confirmation). In this e-mail or in a separate e-mail, but no later than upon delivery of the goods, the text of the contract (consisting of the order, the GTC and the order confirmation) will be sent to the customer by BAER on a durable medium (e-mail or paper printout) (contract confirmation). The text of the contract will be stored in compliance with data protection laws and can be requested in digital or written form at the e-mail address info@baercoil.de. The Buyer will be informed about the shipment of the ordered goods by e-mail as soon as the goods have been handed over by BAER to the transport company.
(3) The contract shall be concluded in German.
§ 3 Services, Prices
(1) BAER endeavours to provide illustrations of the items offered which are as true to the original as possible. However, slight colour deviations are possible.
(2) The total price of the goods including all related price components as well as the payment options and information result from the information provided within the scope of the item description. All prices are final prices plus shipping costs and include the statutory value added tax at the applicable rate.
(3) The buyer has the following payment options: prepayment/bank transfer, cash on delivery, invoice, and PayPal Plus. If the payment method prepayment/bank transfer is selected, we will inform you of our bank details in the order confirmation.
§ 4 Delivery, shipping
(1) The shipping costs are stated in the respective offer under the item Shipping. The goods will be dispatched within 2-3 working days after receipt of payment. Unless otherwise agreed, the goods will be shipped by DHL. BAER bears the shipping risk if the buyer is a consumer.
(2) If, at the time of the Buyer's order, no copies of the product selected by the Buyer are available, BAER will inform the Buyer of this immediately in the order confirmation. If the product is permanently unavailable, BAER shall refrain from issuing a declaration of acceptance. In this case a contract is not concluded. If the product specified by the Buyer in the order is only temporarily unavailable, BAER shall also inform the Buyer thereof without delay in the order confirmation.
(3) In the event of a delay in delivery of more than two weeks, the Buyer has the right to withdraw from the contract. The statutory right of withdrawal of the Buyer (see § 5 of these Terms and Conditions) is not affected by this. Moreover, in this case BAER is also entitled to withdraw from the contract. In this case BAER will immediately refund any payments already made by the Buyer.
§ 5 Right of cancellation for consumer contracts
A contract for the delivery of goods concluded between BAER and the Buyer via https://baer.tools is a distance contract within the meaning of § 312 c paragraph 1 BGB (German Civil Code). The Buyer, who is a consumer within the meaning of § 13 BGB, is entitled by law to a right of revocation pursuant to §§ 312g, 355 BGB (Consumer Revocation in Distance Selling Transactions). A consumer according to § 13 BGB is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity. Further information on the right of withdrawal as a consumer can be found in the following cancellation policy. A cancellation policy in text form will be sent to the Buyer by e-mail. The Buyer may use the cancellation form to exercise the right of cancellation.
